Fantasy Sports Bill Approved By Texas House

AUSTIN (KRLD) - Whether fantasy sports are a game of chance or skill was the central argument State Representative Joe Moody’s bill centers on. It defines "fantasy” as a bona fide contest, reflecting the knowledge and skill of the participants.

“House Bill 2303 (HB 2303) simply seeks to clarify state law and confirm that skills-based fantasy sports are legal and therefore not an act of gambling.”

This bill also attempts to clean up the language found in a recent opinion by Texas Attorney General Ken Paxton, who back in 2016 concluded fantasy sports violated state law. “What this is, is totally unregulated gambling. The reason we say that is because in Texas under the law if there’s any chance at all to a game it’s considered gambling and is therefore illegal.”

HB 2303 was passed on the second reading by a record vote of 116 Yeas, 27 Nays, and 2 Present that didn't vote. The bill is similar to one that has already been passed by 19 other states. After the third reading, it will next head to the Texas Senate.
